How to … find a financial planner

In the past, relatively unqualified people could set themselves up as financial advisers - and live off the high commissions many of their products delivered. But regulations have been tightened, and the industry now boasts a growing body of well-qualified professionals. This week, in our series on how to manage your money, we show you where to find one.

Just as you would use a map for directions on how to get somewhere, you should have a financial plan to make sure that your financial affairs are in order and your financial needs can be met.

However, a plan or map by itself is not nearly as handy as one that is implemented on an ongoing basis with the assistance of a guide, and your financial planner can be your guide.

Financial planners come from varying backgrounds and operate in many different ways. It is critical, when choosing the right planner for your circumstances, to find out exactly who you are dealing with, whether they are qualified and licensed, where their field of expertise lies, and which institutions they are authorised to represent.

You can use either an independent financial planner or a planner who is affiliated to a financial services company. A planner affiliated to a financial services company will be able to advise you only about products from that company whereas someone who operates independently is in a position to give you objective advice and can draw on investment and risk cover solutions from a range of financial institutions.

Until some years ago there were no legislative requirements for financial planners, and many brokers or product-peddlers claimed to fulfil the services of financial planners - to the detriment of their clients. However, this scenario changed in 2002, with the implementation of the Financial Advisory and Intermediary Services (FAIS) Act, which introduced minimum qualifications and operational requirements as well as a code of conduct for financial planners.

Anyone practising in this field has to, in terms of the FAIS Act, have a licence issued by the Financial Services Board to operate as a financial services provider (FSP). Sometimes, you will find that a company holds an FSP licence. The FSP will employ both representatives and "key individuals", who must ensure that all the representatives are fully aware of the requirements of the FAIS Act.

Fit and proper

To get a licence, Financial planners also have to meet "fit and proper" requirements, including:

- Personal honesty and integrity: You cannot practise as a financial planner if, at any time in the past five years, you have been found guilty of unprofessional conduct, or fraud, theft or any other crime;

- Competence: Financial planners must have the relevant experience and qualifications to fulfil their responsibilities;

- Operational requirements: Financial planners must have an office where they can make photocopies and send and receive documents. They must have a telephone and cannot simply operate from a cellphone; and

- Financial soundness: Financial planners cannot be under liquidation or provisional liquidation or have been declared insolvent. In other words, their own financial affairs should be in good order.

QUALITIES OF A PROFESSIONAL - AND WHERE TO LOOK FOR ONE

When you choose a financial planner or adviser, he or she should be someone you feel you can trust because the information you disclose can be very personal. You need to be open about your financial affairs as well as events in your life such as a divorce or the death of a loved one.

As a first step, your planner should clearly explain the services he or she provides and define both parties' responsibilities. This is required in terms of the Financial Advisory and Intermediary Services (FAIS) Act.

Not all financial planners are qualified to give you advice on all aspects of your finances. You may find that your planner can advise you on estate planning but not on tax. If this is the case, he or she may outsource your tax to a qualified tax practitioner (and charge you for the service) or may simply refer you to one.

It is important that you find out upfront exactly what your financial planner is qualified to advise you on. Ideally, you should have a contract setting out details such as how often you will meet, how often you will receive written updates on your investments and policies, payment of fees or commissions, and what would happen if he or she left the company.

In terms of the FAIS Act, your planner should also disclose upfront how he or she will be paid and by whom. Traditionally, financial advisers worked on a commission-only basis, where commission was paid to the adviser directly by the company with which you invested. However, the industry is moving away from the commission-based model to a fee-based one. (See "Fee structures" below.)

Practical ways to find a financial planner

The best type of financial planner is an independent one, not employed by a financial institution, who is able to give you objective advice about your investments. There are a number of ways to find a reputable planner:

1. The website

This website has a database of financial planners licensed as FSPs in terms of the FAIS Act. Launched about four years ago by Certified Financial Planner Chris Preen, the site lists about 500 planners.

There are different fields of financial planning, including retirement planning, investments, estate planning, medical insurance, tax, and life and disability assurance. On the site you can select the fields of expertise in which you want advice. The site then gives you a shortlist of financial advisers with such expertise.

Some details you will find listed under each financial planner include:

- The name of the financial planner's business or employer. This will tell you if the planner is independent or employed by a large institution such as Old Mutual or Sanlam;

- Telephone numbers, email, physical and postal addresses;

- Qualifications - one of the top qualifications is CFP (see below). Others may include BCom, Certified Financial Analyst (CFA) or MBA;

- Details of the planner's employment history - this will give you an idea of where his or her strengths lie;

- The fields in which the planner is qualified to give advice. The search will give you a list of planners who meet your requirements, but they may offer other services as well;

- The financial services companies that the planner works with or represents. This will give you a good idea of whether he or she can shop around to give you the best possible advice. You can also check if the planner has contacts with a specific company you may want to deal with;

- How the planner is paid - on a fee basis or commission basis;

- The minimum level of premium or investment the planner's business accepts;

- The type of business (for example, a CC or a private company), which gives you an indication of its size;

- Details of the planner's professional indemnity insurance and how much he or she is covered for. If you suffer a loss as a result of negligence or poor advice and make a claim for damages, this is the maximum amount the planner's insurer will pay out. Professional indemnity insurance is especially important if you are dealing with a small business or someone who is self-employed.

2. The Financial Planning Institute (FPI) website

The FPI has a search facility for financial planners on its website ( www.fpi.co.za. Click on the link "Find a financial planner" on the bottom left of the screen.

You can also enter the dialling code of the area you live in. The search will give you details of all the financial advisers in that area, with ticked boxes next to those planners who fit your search criteria. The information reflects only the planner's name, certificate level, contact details and suburb. You should be looking for a planner with a CFP qualification.

Or you can look for the details of a financial planner who has been recommended to you by typing in his or her surname.

3. The website of the Financial Services Board (

On the home page, click on the FAIS link at the top right of the screen and then click on "search for financial services providers". If you are looking for a specific planner, you can enter the FSP name. Or enter your postal code to get a list of the registered financial planners in your area. If you are checking that your planner is registered with the FSB, you can do a search using his or her ID number.

The search on the FSB website tells you if the financial planners are licensed and also shows if their licence has expired or been withdrawn. You can also access the financial planner's contact details, the names of the representatives of the company and the products they are approved to sell to you.

4. Financial Planner of the Year

Personal Finance, together with the Financial Planning Institute (FPI), sponsors the annual Financial Planner of the Year competition. The adjudication process involves a complex case study, an on-site audit of the applicant's practice and a face-to-face interview. The competition was won this year by Alec Riddle, a financial planner at Money Talk Lifestyle Financial Planning in Port Elizabeth.

QUALIFICATIONS

When you look for a financial planner, you should preferably deal with someone who is a CFP (Certified Financial Planner) and a member of the Financial Planning Insitute (FPI). A financial planner can become a CFP only once he or she has obtained a post-graduate diploma in financial planning. A CFP is also bound by the FPI's code of conduct and ethics.

FEE STRUCTURES

Traditionally, financial advisers worked on a commission-only basis, but the industry is now moving towards a fee-based model. This is because working on commission creates the potential for the adviser to be biased towards products that pay the highest commissions - and these may not necessarily the best products or advice for you.

Gregg Sneddon, from The Financial Coach in Cape Town, says that in terms of the FAIS Act, advisers should disclose their fee or commission structure to you upfront. This should be agreed to in writing when you formally engage their services.

The alternative to a commission-based model is a fee-based one, but even fee-based advisers have different payment models.

Some advisers may charge you a set fee, which is offset by any commission earned. Others may charge you a set fee and waive all commission. You may find that your initial consultation is free and the adviser only starts charging you thereafter if you decide to use his or her services. The initial meeting gives you the opportunity to decide if the financial adviser is the right one for you.

You may be charged on a per-hour basis, or your financial planner may charge you a fixed fee - for example, from R3 500 for a basic plan to as much as R25 000 for drawing up and implementing a more detailed financial plan, which may include four or five meetings. Some advisers will allow you to pay this once-off fee over several months or may charge you an ongoing monthly fee.

Instead of an hourly fee rate, your financial adviser may charge you according to the service levels required and the size of your investments.

Some advisers may charge you a percentage of the assets under management (the amount you invest on their advice). This fee is usually paid by the investment company directly out of your funds.

“You need to be aware that this fee is negotiable and you don't have to accept the percentage handed to you in an agreement. A few years ago, this fee was usually a maximum of 0.5 percent a year, but recently it has crept up to as much as one percent a year, which is quite high,” Sneddon says.

He says you should read the fine print of your agreement and make sure you clearly understand and know upfront what you are paying for.
