Ben Shaw founder of online rental solutions HouseMe says the key question is whether agents are able to perform inspections.

“Currently this seems to be overlooked in the regulation and is a concern for disputes.“

He says the permit needed to relocate does however provide for affected persons to be listed for each move, and “perhaps a solve is to list the inspector on that permit when it is stamped by an official”.

“Although the Gazette is vague is some respects, we are delighted that we are progressing in the right direction towards a more open industry,” says Shaw.

Those needing to move to their new homes can do so between May 7 to June 7.

The National Property Practitioners Council described it as “a move in the right direction”.

However, they agree it remains unclear how outgoing and incoming inspections are to be conducted and whether real estate practitioners will be granted permission to perform this essential function during the course of the relocations.

“Nonetheless, .... it demonstrates government is listening and open to considering rational views and we will continue to engage with government on the matter of the full re-opening of the commercial and residential real estate sector,” says the council’s chairperson Vuyiswa Mutshekwane.

“Adrian Goslett, regional director and CEO, Re/Max of Southern Africa Described the new regulations as “great but are only useful together with allowing inspections. The RHA requires it, so they will have to amend/add to regulation”.

Bill Rawson, chairman of Rawson Property, says it was a positive move because it allows people to transact and exit unaffordable accommodation especially in the rental market.

“The same applies to commercial and retail accommodation shops and offices.

“This movement will also increase income for the estate agent and legal service industry which is very welcome news. Even the furniture removers will start earning an income again.”
