Cape Town – The Hout Bay businessman accused of murdering Toufiq Joseph was back in the dock this week.

David Forbes’ case was heard at the Cape Town Regional Court on Tuesday.

The State is now awaiting a report from the Department of Correctional Services.

Forbes is accused of intentionally shooting Joseph on January 24, 2015 while he was sitting inside a vehicle at a garage in Orange Street in Gardens.

Joseph was reportedly out on bail at the time of the incident.

Eric Ntabazalila of the National Prosecuting Authority said the State was waiting on the report before they could proceed.

“He is charged with the murder of a man he was seen arguing with at a garage in Orange Street, Gardens,” Ntabazalila explained.

“The State alleges the accused pulled out a firearm and fired four shots at the deceased while he was sitting in his car.

“He then waited for the police and handed himself over.

“The case has been postponed for a correctional service report.”

Forbes allegedly admitted at the time of the incident that he shot Joseph and that he acted in self-defence.

Forbes claimed he was attacked with a knife before he allegedly opened fire.

Forbes is currently out on R20 000 bail.

Forbes began the H20 party brand and then became a consultant for the Ultra music festival in South Africa.
